Iniciativa popular legislativa y su eficacia como mecanismo de participación ciudadana

Abstract

La democracia es entendida como aquella herramienta que posee la ciudadanía para participar activamente en las decisiones de un Estado, en la cual prima siempre la igualdad y el respeto por las normas; y así mismo, el Estado busca el cumplimiento de los fines estatales, plasmados previamente en un documento supremo que le permita a cualquier ciudadano comprender cuáles son sus derechos y obligaciones. Como producto de esas herramientas de participación ciudadana, se deriva el mecanismo de la iniciativa legislativa popular; la cual pretende que mediante la participación de un grupo determinado de personas se puedan presentar proyectos de acto legislativo y de Ley ante el Congreso de la República, de Ordenanza ante las Asambleas Departamentales o de Acuerdos ante los Concejos Municipales para que sea debatida, aprobada, modificada o negada dicho proyecto.

Pese a existir dicho mecanismo, su eficacia no es cumplida, al ir en contra vía de su objetivo contenido en un imperativo de conducta. En Colombia solo han sido presentadas 10 iniciativas legislativas populares, de las cuales cinco no han pasado por falta de firmas, dos han sido retiradas y tres han sido rechazadas en el Congreso, para un total de cero aprobadas; de conformidad con lo anterior, esta investigación tiene por objetivo revisar la eficiencia de la norma desde el punto de vista de su aplicación.

Democracy is understood as that tool that citizens have to actively participate in the decisions of a State, in which equality and respect for the rules always prevail, and likewise, the State seeks the fulfillment of the state purposes previously embodied. in a supreme document that allows any citizen to understand what their rights and obligations are; derived from these tools of citizen participation, the mechanism of the popular legislative initiative is derived, which pretends that through the participation of a certain group of people, projects of legislative act and of Law can be presented before the Congress of the Republic, of Ordinance before the Departmental Assemblies or of Agreements before the Municipal Councils so that said project is debated, approved, modified or denied. Despite the existence of said mechanism, its effectiveness is not fulfilled, going against its objective contained in an imperative of conduct, in Colombia only 10 popular legislative initiatives have been presented, of which 5 have not passed due to lack of signatures, 2 have been withdrawn and 3 have been rejected in Congress, for a total of 0 approved, in accordance with the above, this research aims to review the efficiency of the standard since its application.
