Estudio comparativo de los mecanismos de protección de los derechos humanos y los derechos fundamentales en Colombia

Abstract

Esta monografía, propone como objetivo analizar comparativamente los mecanismos de protección de los derechos humanos y los derechos fundamentales en Colombia. El desarrollo de este estudio monográfico, resulta importante, considerando la imprecisión que existe, por parte de los ciudadanos sobre la pertinencia de cada uno de los mecanismos de protección de los derechos humanos y fundamentales, en el momento de invocarlos, según la correspondencia que tengan en relación con la vulneración que se haga de los mismos. En ese sentido, es un aporte que busca precisar las condiciones y/o requisitos que implica cada uno de los mecanismos de protección de los derechos humanos y fundamentales establecidos por las diferentes instancias internacionales y por Constitución política. El proceso metodológico obedece al enfoque de Investigación Cualitativa que se orienta en la comprensión y análisis de las problemáticas existentes en determinada realidad, situación o fenómeno, objeto de investigación. En cuanto al método a seguir en este estudio, es de carácter descriptivo analítico. La información requerida para la investigación se basó en el análisis de documentos bibliográficos relacionados con los diferentes tópicos de la temática, materia de estudio, además de las leyes y jurisprudencias referentes promulgados acerca de los mecanismos de protección de los derechos humanos. En las conclusiones se resalta que los mecanismos de protección están muy ligados con los derechos humanos y particularmente con los derechos fundamentales consagrados en la Constitución Política, como quiera que en ambos casos tienen el carácter pro homine, es decir abogan por el respecto al desarrollo integral del ser humano Por otra parte, resulta conveniente sugerir la importancia de motivar mayor interés en las facultades y estudiantes del derecho por dilucidar en todos sus alcances y procedimientos cada uno de los mecanismos de protección, de manera tal que se evite la congestión del sistema, la pérdida de tiempo y de recursos que le restan efectividad a estos instrumentos de protección de los derechos ciudadanos.

The objective of this monograph is to analyze comparatively the mechanisms for the protection of human rights and fundamental rights in Colombia. In this sense, it is a contribution that seeks to specify the conditions and / or requirements implied by each of the mechanisms for the protection of human and fundamental rights established by the different international bodies and by the Political Constitution. The methodological process obeys the Qualitative Research approach that it is oriented in the understanding and analysis of the existing problems in a certain reality, situation or phenomenon, object of investigation. As for the method to be followed in this study, it is descriptive and analytical. The information required for the research was based on the analysis of bibliographic documents related to the different topics of the subject, subject of study, in addition to the relevant laws and jurisprudence promulgated about the mechanisms for the protection of human rights. The conclusions highlight that the protection mechanisms are closely linked to human rights and particularly with the fundamental rights enshrined in the Political Constitution, as in both cases they have a pro homine character, that is, they advocate respect for integral development. of the human being On the other hand, it is convenient to suggest the importance of motivating greater interest in the faculties and students of the law to elucidate in all its scopes and procedures each one of the protection mechanisms, in such a way as to avoid the congestion of the system, the loss of time and resources that reduce the effectiveness of these instruments for the protection of citizens' rights.
